These Terms & Conditions ("Terms") govern your access to and use of our website (multanisamaj.com) and genealogy management services. By accessing, browsing, or using Multani Gharana in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any provision of these Terms, you are prohibited from using or accessing the Platform.

We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Platform after changes constitute your acceptance of the updated Terms.

3. User Eligibility & Registration

3.1 Age Requirement

3.2 Account Information

When registering, you agree to provide accurate, complete, and truthful information. You are responsible for maintaining the confidentiality of your password and account credentials. You agree to notify us immediately of any unauthorized access to your account.

3.3 Account Responsibility

You are solely responsible for all activities that occur under your account. You agree not to share your account credentials with others. We will not be liable for any unauthorized access or misuse resulting from your failure to protect your password.

3.4 Right to Refuse Service

We reserve the right to refuse registration or terminate accounts that violate these Terms or our policies.

4. User Obligations & Conduct

You agree not to use the Platform for:

• Illegal activities or violations of any law, regulation, or third-party rights
• Harassment, threats, abuse, or defamation of other Users
• Posting false, misleading, or fraudulent genealogical information
• Spam, phishing, or social engineering attempts
• Uploading viruses, malware, or malicious code
• Unauthorized access or hacking attempts
• Violating intellectual property rights
• Commercial solicitation or advertising without permission
• Impersonation of any person or organization
• Any activity that disrupts the Platform's functionality

We will investigate violations and may suspend or permanently ban users who breach these obligations.

5. Intellectual Property Rights

5.1 Platform Ownership

Multani Gharana and all its content (design, code, functionality, text, images, logos) are the exclusive intellectual property of Multani Gharana or our licensors. You may not reproduce, modify, distribute, or use any content without explicit written permission.

5.2 User-Generated Content

You retain ownership of any genealogical data, photos, documents, and information you upload to the Platform. By uploading content, you grant Multani Gharana a non-exclusive, worldwide license to:

• Store and process your content
• Display it according to your privacy settings
• Back up and protect your data
• Share it with Users you authorize

5.3 Limited License to Use Platform

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for personal genealogical purposes only. You may not sell, redistribute, or modify the Platform's services.

5.4 Third-Party Content

The Platform may contain links to and content from third-party websites. We do not endorse, control, or assume responsibility for third-party content.

6. Genealogical Data & Records

6.1 Data Accuracy

Users are responsible for the accuracy and truthfulness of genealogical information they submit. We do not verify historical accuracy or family relationships. We are not liable for disputes over genealogical claims or family relationships.

6.2 Sharing Family Data

When you share your genealogical tree with other Users, those Users may:

• View the shared information according to your privacy settings
• Add information to shared records (depending on permissions)
• Contact other family members through the Platform

You are responsible for obtaining consent from other family members before sharing their information. We are not liable for privacy breaches resulting from your voluntary sharing.

6.3 Membership Claims & Verification

Users may submit claims for family membership. Multani Gharana reserves the right to:

• Request documentation to verify claims
• Approve or reject membership applications
• Suspend Users who submit false claims
• Delete unverified or fraudulent genealogical data

6.4 Dispute Resolution

Multani Gharana does not mediate disputes between Users regarding genealogical accuracy or family relationships. Such disputes are solely between the Users involved.

7. Membership & Payments

7.1 Free vs. Paid Membership

Multani Gharana offers both free and premium membership tiers. Features available vary by membership level. We reserve the right to modify features or pricing at any time.

7.2 Payment Terms

All payments are processed through secure third-party payment gateways (such as Paytm). Payment information is handled by these processors, not by Multani Gharana. We are not responsible for payment processing errors by third parties.

7.3 Billing & Renewal

Premium memberships will automatically renew at the end of each billing period at the rate disclosed during purchase. You are responsible for keeping your payment information current. Failed payments may result in service suspension.

7.4 Cancellation & Refunds

You may cancel your membership at any time through your account settings. Refunds are issued according to our refund policy. Once cancelled, you will lose access to premium features, but your genealogical data will remain accessible with basic features.

7.5 No Refund for Accidental Purchases

Multani Gharana is not responsible for refunds due to accidental purchases or unauthorized account access. Users are responsible for securing their accounts.

8. Privacy & Data Protection

Your use of Multani Gharana is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

By accepting these Terms, you consent to the collection, use, and storage of your information as described in the Privacy Policy.

9. Limitation of Liability

10. Service Availability & Maintenance

10.1 No Guarantee of Uptime

While we strive to maintain 99.9% uptime, we make no guarantee that the Platform will be:

• Available at all times
• Error-free or uninterrupted
• Free from viruses or malicious code
• Secure against unauthorized access

10.2 Maintenance & Updates

We may temporarily suspend the Platform for maintenance, updates, or emergency repairs without advance notice. We will endeavor to provide notice when possible.

10.3 Service Termination

We reserve the right to discontinue or modify any feature or the entire Platform at any time. Users will be given reasonable notice (at least 30 days) before complete service termination.

11. Content Policy & Moderation

• Suspend or terminate accounts posting prohibited content
• Report illegal content to authorities

11.3 No Obligation to Monitor

We are not obligated to monitor User content. However, we reserve the right to do so at any time.

You agree to indemnify, defend, and hold harmless Multani Gharana, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your genealogical data or claims
• Your infringement of third-party rights
• Disputes with other Users

Multani Gharana may contain links to third-party websites and services (such as Paytm for payments). We do not:

• Endorse or control third-party content
• Assume responsibility for third-party services
• Warrant the accuracy or safety of external links

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14.2 Dispute Resolution

14.3 Jurisdiction

Any legal proceedings shall be governed by Indian law and conducted in courts located in India. You irrevocably consent to the jurisdiction and venue of such courts.

14.4 Arbitration Option

For disputes that cannot be resolved through negotiation, either party may initiate binding arbitration. The arbitration shall be conducted in English and governed by Indian arbitration laws.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full effect.

16. Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Multani Gharana regarding your use of the Platform. Any previous agreements or understandings are superseded by these Terms.
